By using ERPConsult.ai (the “Platform”), you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the Platform.
1) What this document covers
- Your use of the Platform, website, and any related apps, APIs, and services.
- The relationship between:
- Consultants (individuals offering services),
- Recruiters (individuals who source candidates),
- Agencies/Integrators (firms sourcing candidates), and
- ERPConsult.ai (us).
2) Key definitions
- Account: Your registered profile on ERPConsult.ai.
- Consultant Content: CVs, profiles, availability, rates, and any information a consultant provides.
- Recruiter/Agency Content: Job needs, role descriptions, notes, and searches.
- User Content: Any content you submit or upload.
- You: Any person or entity using the Platform.
- We/Us: ERPConsult.ai and its legal entity listed above.
3) Who can use the Platform
- You must be 18+ and able to enter a binding contract.
- If you use the Platform for a company, you confirm you have authority to bind that company.
- You must comply with local laws where you live or work. Access may not be legal in all places; that’s your responsibility.
4) Accounts, security, and login
- Keep your login details secret. You’re responsible for all activity under your account.
- Tell us right away if you suspect unauthorized access.
- We may suspend or close accounts for misuse, fraud, or breach of these Terms.
5) What ERPConsult.ai is (and is not)
- We connect Consultants with Recruiters/Agencies.
- We are not an employer, agent, or representative of any user.
- We do not guarantee a job, a project, a hire, or any outcome.
- We do not routinely verify identities, skills, or claims unless we say so in writing for a specific feature.
6) Your obligations (all users)
You agree to:
- Provide accurate, current information.
- Use the Platform for lawful, professional purposes.
- Respect privacy and data rights of others.
- Follow these Terms and any posted policies or guidelines.
You agree not to:
- Upload false, misleading, or deceptive content.
- Harass, threaten, discriminate, or defame.
- Scrape, harvest, or copy data at scale.
- Reverse engineer, bypass security, or overload systems.
- Upload malware or harmful code.
- Build or train a competing database from our content.
- Use the Platform in violation of sanctions or export laws.
7) Consultant responsibilities
- Upload only your own CV/profile. Keep it accurate and updated.
- If you list availability or rates, keep them honest and timely.
- Do not post confidential information you’re not allowed to share.
- You are responsible for your own contracts, taxes, work permits, and compliance when you accept a role off-platform.
8) Recruiter & Agency responsibilities
- Use consultant data only for bona fide hiring or staffing.
- Do not spam, mass-message, or resell consultant data.
- Respect opt-outs and availability.
- Follow all hiring and employment laws that apply to you (e.g., anti-discrimination, pay transparency where required).
- Manage your own contracts, background checks, and onboarding outside the Platform.
9) Content rights and licenses
- You own your User Content.
- You grant ERPConsult.ai a non-exclusive, worldwide, transferable, sublicensable, royalty-free license to host, store, display, index, and use your User Content only to operate, improve, and promote the Platform (for example: showing a consultant profile to recruiters, sending availability alerts, generating search results, creating anonymized market insights).
- You represent you have the rights to post what you post.
- We may remove or edit content that breaks these Terms or the law.
10) Publicity and logos
- If you are a paying business customer, you grant us permission to use your company name and logo on our customer lists, website, and sales materials.
- You can opt out by emailing us at [Legal/Support Email].
11) Profile visibility and communications
- Consultant profiles are visible to paying recruiter/agency users as described on the pricing page.
- Recruiters/agencies may contact consultants using contact methods shared on the Platform.
- We may send you service emails, tips, alerts, and notices. You can opt out of non-essential emails.
12) Plans, fees, billing, and taxes
- Current plans and prices appear on the pricing page or your order form.
- Unless stated otherwise, fees are non-refundable (except where required by law).
- Subscriptions renew automatically unless you cancel before renewal.
- Upgrades take effect immediately; downgrades at the next billing cycle.
- Prices may change. We will notify you in advance.
- Taxes (VAT/GST/sales tax/withholding) may apply. You’re responsible for taxes unless local law requires us to collect them.
13) Free, Pro, and Elite consultant plans
- Free: core visibility features as described.
- Pro/Elite: paid features as described.
- We may change features or availability of plans with notice.
- Abuse of any plan may result in limits, suspension, or termination.
14) Recruiter and Agency plans
- Solo, Team/Growth, and Pro plans are described on the pricing page.
- Seats are for named users (unless stated otherwise). Do not share logins.
- We may apply fair-use limits (e.g., search volume, exports) to protect the platform and users.
15) Trials, promos, and coupons
- Trial terms will be shown at sign-up.
- We may modify or end a promo at any time.
- Coupons are single-use unless stated, and cannot be combined.
16) Refunds and chargebacks
- Except where your local law requires otherwise, all fees are non-refundable.
- If you dispute a charge with your bank instead of contacting us first, we may suspend your account during the investigation.
17) Data protection and privacy (summary)
- Our Privacy Policy explains what data we collect and how we use it.
- We do not sell personal data.
- We use service providers (hosting, analytics, email, payments) who process data on our behalf.
- We apply reasonable safeguards to protect data; no system is perfect.
- For EU/UK users: we rely on standard contractual clauses or other lawful transfer tools for international transfers where needed.
- For California users: we handle personal information as described in our Privacy Policy.
- Requests to access, correct, or delete personal data: email [Privacy Contact Email].

18) Third-party services and links
- The Platform may link to third-party websites or services.
- We’re not responsible for those sites, their content, or their policies.
- Your use of third-party services is at your own risk and bound by their terms.
19) Acceptable use and fair use
You agree to reasonable limits so the service remains reliable for everyone. We may set or adjust:
- Search and export limits,
- Rate limits and API limits (if an API is offered),
- Measures to stop scraping, copying, or mass harvesting.
We may monitor use to keep the Platform safe and stable.
20) Sanctions and export control
You may not use the Platform if you are located in, or are a resident of, a country or region subject to comprehensive sanctions, or if you are on a restricted party list under applicable law. You agree to comply with all export and sanctions rules that apply to you.
21) No bypass or resale
- Do not resell access, share credentials, or redistribute data from the Platform.
- Do not build a substitute or competing database using our content.
- Do not use the Platform to create a data set for training or seeding any other system.
22) Background checks, verification, and references
- We do not run background checks by default.
- If any “verification” is shown, it refers only to the specific check described (for example, email confirmed), not a full vetting.
- Recruiters and agencies must run their own checks as needed and comply with law.
23) Job posts and equal opportunity
- If you post roles, you must follow your local employment and anti-discrimination laws.
- Do not post roles that are illegal, misleading, or unsafe.
24) Intellectual property on the Platform
- The Platform, site design, and software are owned by ERPConsult.ai or our licensors.
- You may not copy, modify, or create derivative works from our software or design.
- You may not remove notices or trademarks.
25) Reporting IP infringement (notice procedure)
If you believe your IP is used on the Platform without permission, email [IP Notices Email] with:
- Your full contact details,
- A description of the work you claim is infringed,
- The exact location (URL or screen) of the material,
- A statement that you have a good-faith belief the use is not authorized,
- A statement that your notice is accurate, and
- Your signature (typed name is fine).
We may remove or restrict content while we review. We may notify the user who posted it.
26) Feedback
If you share feedback or suggestions with us, you allow us to use it without restriction or payment. Do not send confidential ideas.
27) Service changes and downtime
- We may change, add, or remove features.
- The service may be unavailable for maintenance, upgrades, or issues.
- We’ll try to give reasonable notice for planned maintenance.

- We try to respond promptly, but we do not promise any specific response time unless stated in your plan.
29) Disclaimers
- The Platform is provided “as is” and “as available.”
- We do not promise that searches, matches, or results will meet your expectations or business goals.
- We do not promise uninterrupted service or error-free operation.
- You use the Platform at your own risk.
30) Limitation of liability
To the fullest extent allowed by law:
- We are not liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, loss of business, or reputational harm).
- Our total liability for any claim relating to the Platform will not exceed the greater of:
- the amount you paid to us in the 12 months before the claim, or
- USD 500 (or the equivalent in your local currency) if you paid nothing.
Some places do not allow certain limits; in those places, we limit our liability to the maximum allowed by law.
31) Indemnity
You agree to defend, indemnify, and hold ERPConsult.ai (and our officers, directors, employees, and agents) harmless from claims, losses, costs, and legal fees that arise from:
- Your use of the Platform,
- Your User Content,
- Your breach of these Terms or the law, or
- Any dispute between you and another user.
32) Suspension and termination
We may suspend or terminate your account if:
- You breach these Terms or our policies,
- Your use risks the Platform’s security or stability,
- We are required by law or a court, or
- You fail to pay fees when due.
You may close your account at any time. On termination:
- Your right to access the Platform ends,
- We may keep limited records as required by law or for legitimate business purposes,
- We may retain backup copies for a limited time.
33) Data retention and deletion
- We retain personal data as needed for the purposes described in the Privacy Policy and as required by law.
- You can request deletion of your account and data; we will handle it under the Privacy Policy and applicable law.
- We may retain anonymized data that no longer identifies you.
34) International use and local laws
- You are responsible for following local laws where you use the Platform.
- Some features may be limited in certain countries due to regulations.
35) Changes to these Terms
- We may update these Terms. If changes are significant, we will notify you by email or by posting a notice on the Platform.
- The new Terms apply from the effective date we state. If you keep using the Platform after that date, you accept the changes.
36) Assignment
We may assign these Terms (for example, in a merger or sale). You may not assign your rights or obligations without our written consent.
37) Entire agreement; no waiver
These Terms (plus any order form and the Privacy Policy) are the entire agreement between you and us about the Platform.
If we do not enforce a term, it does not mean we waive that right later.
38) Severability
If any part of these Terms is found invalid or unenforceable, the rest stays in effect.
39) Governing law and disputes
- These Terms are governed by the laws of [Choose Country/State], without regard to conflict-of-law rules.
- Venue: Courts located in [City/Country] shall have exclusive jurisdiction, unless your local law requires a different venue.
- If binding arbitration or a different dispute process is required by your local law, that process will apply.
